This is a list of example cases from the many we have been involved in and has had to be limited to a manageable number. We have tried to provide details of a variety but it should be noted that for example in personal injury or family or property work there are often many cases which have a similar negligent cause even though individual facts will vary.
- Failing to identify and advise correctly on an available Defence e.g. in commercial proceedings brought by a Bank, in Probate proceedings and on a Defence to a claim to possession by a commercial Landlord.
- Failing to advise correctly on a Lease Renewal of a Business Tenancy.
- Failing to advise correctly in a Partnership action.
- Failing to advise correctly over the terms of a commercial Lease.
- Failing to issue Court proceedings in time or against the correct Defendant or failing to serve Court proceedings validly e.g. in time or by the correct method.
- Failing to advise correctly on the terms of a settlement leading to an under-settlement.
- Failing to advise correctly on a viable claim which is therefore not pursued.
Failing to identify and advise correctly on injuries or losses suffered and caused by an accident.
- Failing to prepare cases properly for Court.
- Pursuing a case, which is hopeless.
- Pursuing a case when it was no longer a viable case and wasting unnecessary costs.
- Failing to advise correctly in a Divorce or family case including financial claims.
- Failing to identify and advise on the negligence of a previous solicitor.
- Failing to advise correctly on the title to a property, including failure to advise correctly on documents seen and also in not making further searches and enquiries. E.g. on rights of way, common land, mine workings and shafts, land not within title or subject to onerous rights or obligations.
- Causing or permitting a Court case to be struck out or a Defendant to be debarred from defending.
- Failing to take enforcement action in time or at all.
- Failing to register a right or charge at the Land Registry
